By downloading, installing, or using the Braindead mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Description of Service
Braindead is an iOS screen time management application that helps users:
- Block access to distracting apps during focused work sessions
- Set time limits and scheduling rules for app usage
- Participate in social challenges and leaderboards with friends
- Track progress through gamified scoring systems
The App uses Apple's Screen Time API and Family Controls framework to provide blocking functionality, and Apple's CloudKit for social features and data synchronization.
2. Account Registration and User Conduct
2.1 Account Creation
- You must create a username to participate in social features
- Usernames must be appropriate and not infringe on others' rights
- You are responsible for maintaining the security of your account
2.2 Prohibited Conduct
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Use offensive, harmful, or inappropriate usernames
- Attempt to reverse engineer or modify the App
3. Screen Time and Device Management
3.1 Permissions Required
The App requires several iOS permissions to function:
- Family Controls: To block apps and manage device restrictions
- Screen Time API: To monitor app usage for blocking purposes
- CloudKit: To sync data and enable social features
3.2 Blocking Functionality
- App blocking uses Apple's native Screen Time controls
- Blocking effectiveness depends on iOS system functionality
- Emergency access may be available through iOS settings
- We are not responsible if blocking features fail or are circumvented
3.3 User Responsibility
- You are responsible for your own screen time management
- The App is a tool to assist with self-control, not a guarantee
- Parents/guardians are responsible for minors' app usage
4. Social Features and User Content
4.1 Social Features
- Leaderboards and friend connections are optional features
- All social data is stored in Apple's CloudKit Public Database
- Other users may see your username and scores if you participate in social features
4.2 User-Generated Content
- You retain ownership of usernames you create
- You grant us a license to display your username and scores in social features
- We reserve the right to remove inappropriate usernames or content
5. Subscription Services
5.1 Premium Features
- All features require a paid subscription
- Subscriptions are processed through the Apple App Store
- Subscription terms are governed by Apple's Terms of Service
5.2 Billing and Cancellation
- All billing is handled by Apple or Superwall
- Cancellation must be done through your Apple ID account
- Refunds are subject to Apple's refund policies
6. Privacy and Data
6.1 Data Collection
- We collect minimal data as described in our Privacy Policy
- Most data is stored in Apple's CloudKit, not on our servers
- We do not have direct access to your screen time usage data
6.2 CloudKit Data
- Social features require data storage in Apple's CloudKit
- This data is governed by Apple's CloudKit Terms of Service
- You can control this data through your iCloud account settings
7. Intellectual Property
7.1 Our Rights
- The App and its contents are owned by us and protected by copyright and other laws
- Our trademarks, logos, and brand features are our property
- You may not use our intellectual property without permission

- We do not claim ownership of your username or personal data
8. Disclaimers and Limitations

- The App is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service

- The App is not a medical device or health treatment
- Consult healthcare professionals for serious screen time or addiction issues
- We are not responsible for any health impacts of screen time management
8.3 Device Compatibility
- The App requires iOS and compatible Apple devices
- We are not responsible for device compatibility issues
- System updates may affect App functionality
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the App in the past 3 months
- We are not liable for damages caused by third-party services (Apple, Superwall)
10. Third-Party Services
10.1 Apple Services
- The App relies on Apple's iOS, CloudKit, and Screen Time APIs
- Your use of these features is also governed by Apple's Terms of Service
- We are not responsible for changes to Apple's services
11. Termination
11.1 Termination by You
- You may stop using the App at any time by deleting it from your device
- Subscription cancellations must be done through Apple
11.2 Termination by Us
We may terminate or suspend your access if you:
- Violate these Terms
- Use the App in ways that harm other users or our service
- Engage in fraudulent or illegal activities
12. Age Requirements
12.1 Minimum Age
- You must be at least 4+ years old to use the App
- Users under 18 must have parental consent
12.2 Parental Responsibility
- Parents are responsible for minors' use of the App
- Screen Time management for minors should be supervised by parents

For users who download the App through the Apple App Store, you acknowledge that:
- Apple is not a party to these Terms
- Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support for the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any)
- Apple is not responsible for addressing any claims relating to the App
- Apple and its subsidiaries are third-party beneficiaries of these Terms
