Terms of Service

By downloading, installing, or using the "MUSE" mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. App Description

MUSE is an AI-powered image generation and editing application. The App includes Photo Gen (text-to-image generation), AI Retouch (image editing with prompts), and example prompt library features powered by advanced AI image processing technology. The App requires iOS and is available exclusively on iPhone through the App Store.

2. User Authentication and Accounts

2.1 Apple ID Authentication

• You must use your existing Apple ID to authenticate with the App
• No separate account is created—the App uses your Apple ID for identification and subscription verification
• You are responsible for maintaining the security of your Apple ID credentials
• The App integrates with Apple's authentication services for secure access

3. Subscriptions and Credits

3.1 Credit System

• Generation requests consume credits from your account balance
• Your credit balance is displayed in the app
• Subscription plans include a monthly credit allowance
• Different models and features may consume different amounts of credits
• Credits are tied to an active subscription—an active, valid subscription is required to use credits for generation requests
• When your subscription expires, any remaining credits become unusable and cannot be used without renewing your subscription
• Unused credits may expire according to your subscription terms

3.2 Subscriptions

• Subscriptions are managed in‑app and processed by the App Store
• All payments are processed securely by Apple
• Subscriptions automatically renew unless cancelled
• You can manage and cancel subscriptions through iOS Settings: [Your Name] > Subscriptions
• Refund requests are subject to Apple's App Store policies

4. User Content and Generated Images

4.1 Input Images and Prompts

• You grant MUSE permission to process images and text prompts you provide for generation purposes
• Input materials are used only to create requested outputs and are not stored after processing
• You are responsible for ensuring you have rights to use input materials
• Do not upload images or content that infringe on others' intellectual property or privacy rights
• You represent that any images you upload are either owned by you or used with proper authorization

4.2 Generated Images

• You own the images generated by MUSE based on your input
• Generated images are delivered to you for download and personal use
• You retain all rights to use generated images as needed
• The App grants you a license to use generated images personally and commercially
• MUSE does not claim ownership of images you generate

5. Acceptable Use and Prohibited Conduct

5.1 General Prohibited Activities

You agree not to:

• Use the App for any illegal, unauthorized, or harmful purpose
• Attempt to circumvent App security, authentication, or payment systems
• Reverse engineer, decompile, or attempt to extract App source code
• Use the App in violation of applicable laws or regulations
• Generate content that violates intellectual property rights of others

5.2 Responsible Image Generation

Do not use the App to create, upload, or generate illegal content or content that violates others' rights. Prohibited content includes but is not limited to: non-consensual intimate imagery, hate speech, defamatory content, infringing material, or content used to harass or threaten others. You are solely responsible for the content you generate using the App.

5.3 Enforcement and Reporting

• MUSE reserves the right to investigate reports of prohibited conduct
• Violations may result in immediate account suspension or termination
• We cooperate with law enforcement when required
• Report violations by emailing elijah@aimacaron.com with details and evidence

6. Service Providers

We use third‑party service providers to operate the App (for example, for authentication, hosting, networking, image processing, and support). For details and categories of providers, see our Privacy Policy.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect, how we use it, and your choices. By using the App, you agree to the Privacy Policy.

8. Disclaimers and Limitations

8.1 Service Availability

• The App requires a stable internet connection for full functionality
• Processing times may vary based on system load and request complexity
• MUSE is not liable for delays, failures, or data loss caused by technical issues
• Service may be temporarily unavailable for maintenance or updates

8.2 Image Quality and Accuracy

• Generated images are created by AI and may not always match requests exactly
• Results vary based on input quality, prompts, selected models, and system capabilities
• MUSE does not guarantee specific visual outcomes or artistic merit
• Different AI models may produce different results for the same input

8.3 Limitation of Liability

• MUSE is provided "as is" without warranty of any kind
• We are not liable for indirect, incidental, or consequential damages arising from App use
• Our liability is limited to the amount you paid for subscriptions in the 12 months prior to the claim
• We are not responsible for how you use generated images or any consequences thereof

9. Termination

9.1 User Termination

• You may stop using the App at any time
• Uninstalling the App removes your local data and access to features
• Cancel your subscription anytime through iOS Settings

9.2 App Termination

• MUSE may suspend or terminate access for Terms violations or abuse
• Termination will result in loss of access to all App features and credits
• Data associated with your account may be deleted

10. Changes to Terms

• These Terms may be updated from time to time as the App evolves
• Significant changes will be communicated through the App
• Continued use after changes constitutes acceptance of updated Terms
• You may stop using the App if you disagree with changes

11. Governing Law

• These Terms are governed by the laws of California, USA
• Any disputes will be resolved under California law
