By downloading, installing, or using the "indulge" mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. App Description

indulge is a couples-focused mobile application designed to strengthen relationships through shared experiences, interactive games, and personalized widgets. The App requires iOS 17+ and is available exclusively on iPhone devices.

2. User Authentication and Pairing

2.1 Apple ID Authentication

• You must use your existing Apple ID to authenticate with the App
• No separate account is created - the App uses your Apple ID for CloudKit access
• You are responsible for maintaining the security of your Apple ID credentials
• The App uses Apple's CloudKit for authentication and data synchronization

2.2 Partner Pairing

• The App requires pairing with a romantic partner to access most features
• Pairing is established through a unique 6-character code system
• Both partners must consent to the pairing and agree to these Terms
• Only one active partner pairing is allowed per user at any time
• Pairing can be terminated by either partner at any time

2.3 Mutual Consent

• By pairing with a partner, both users consent to share certain data through CloudKit
• This includes photos, messages, location data, game responses, and timeline entries
• Both partners are responsible for the content shared through the App

3. Subscription and Premium Features

3.1 Subscription Requirements

• All App features require an active subscription
• One subscription covers both partners in a pair
• Subscription options include monthly and annual plans
• Prices are displayed in the App and may change with notice

3.2 Subscription Sharing

• When paired, both partners receive premium access through a single subscription
• If the subscription lapses, both partners lose premium access
• Unpairing does not affect subscription status for the subscriber
• Subscription management is handled through Apple's App Store

3.3 Payment and Billing

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled
• You can manage your subscription through iOS Settings
• Refunds are subject to Apple's App Store policies

4. App Features and Content

4.1 Core Features

• Games & Quizzes: Interactive relationship-focused games and questions
• Locket: Photo sharing between partners with optional captions
• Timeline: Shared memory creation with photos and descriptions
• Todo Lists: Shared goal tracking with photo completion
• Distance Widget: Real-time distance tracking between partners
• Widgets: Home screen and lock screen widgets for quick access

4.2 Content Creation and Sharing

• Users can create and share photos, messages, and personal content
• All shared content requires mutual consent between partners
• Content is stored locally and synchronized via CloudKit
• Users retain ownership of their original content

4.3 Location Services

• The App requests location permissions to calculate distance between partners
• Location data is used solely for distance calculations and widgets
• Location sharing requires explicit consent from both partners
• Location data is not shared with third parties

5. Data and Privacy

5.1 Data Collection

• The App does not collect, store, or have access to any user data
• All data is handled directly by Apple's CloudKit service
• Data is stored locally on your device and synchronized via CloudKit
• Profile pictures and personal information are managed through the App

5.2 Data Sharing

• Data is shared only between paired partners through CloudKit
• No data is shared with third parties except as required by law
• CloudKit provides end-to-end encryption for shared data
• Users control what data is shared through the App

5.3 Data Retention

• Data is retained as long as the App is installed and paired
• Unpairing removes shared data from both devices
• Deleted content cannot be recovered
• Users can request data deletion through App settings

6. Acceptable Use

6.1 Prohibited Activities

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Share inappropriate, offensive, or harmful content
• Attempt to circumvent App security or pairing restrictions
• Use the App to harass, abuse, or harm others

6.2 Content Standards

• All shared content must be appropriate and consensual
• Users are responsible for ensuring content complies with these Terms
• The App reserves the right to remove inappropriate content
• Repeated violations may result in account termination

7. Intellectual Property

7.1 App Ownership

• The App and its content are owned by the App developers
• Users retain ownership of their original content
• The App's design, functionality, and code are protected by copyright

7.2 User Content License

• By sharing content through the App, you grant your partner access to view and interact with that content
• This license is limited to the App's functionality and your partner's use
• The license terminates when you unpair or delete the content

8. Disclaimers and Limitations

8.1 Service Availability

• The App requires internet connectivity for full functionality
• CloudKit synchronization may be delayed due to network conditions
• The App is not responsible for data loss due to technical issues

8.2 Content Accuracy

• The App does not verify the accuracy of user-generated content
• Users are responsible for the truthfulness of their shared content
• The App is not liable for any consequences of shared content

8.3 Third-Party Services

• The App integrates with Apple's CloudKit and App Store services
• These services are subject to their own terms and privacy policies
• The App is not responsible for third-party service issues

9. Termination

9.1 User Termination

• You may stop using the App at any time
• Unpairing will remove shared data from both devices
• Cancelling your subscription will remove premium access

9.2 App Termination

• The App may terminate or suspend access for Terms violations
• Termination will result in loss of access to all App features
• Shared data may be permanently deleted upon termination

10. Changes to Terms

• These Terms may be updated from time to time
• Users will be notified of significant changes
• Continued use of the App constitutes acceptance of updated Terms
• Users who disagree with changes should stop using the App

11. Governing Law
